Every highlighted field must be completed with your real details, and the whole document should be reviewed and finalized by a licensed attorney before it goes live or you run a promotion. Sweepstakes are regulated by state law: promotions with a total prize pool over certain thresholds require registration and bonding in New York and Florida (and retail registration in Rhode Island) before the start date, and the arbitration/class-action-waiver, eligibility, and AMOE mechanics below all have legal consequences. No purchase or payment of any kind is necessary to enter or win this sweepstakes. A purchase or payment of any kind will not increase your chances of winning.

All Disputes Will Be Resolved Solely By Binding Arbitration and Entrants Waive The Ability To Bring Claims In A Class Action Format.

Void where prohibited by law.

By entering (or otherwise participating in) the Sweeps (defined below), entrants agree to these Rules, which are a binding contract, so read them carefully before entering. Without limitation, this contract includes indemnities to the Released Parties from you and a limitation of your rights and remedies.

Eligibility

The teargirl [MONTH YEAR] Sweepstakes (“Sweeps”) is open only to individuals who are legal permanent residents of and physically located in one (1) of the fifty (50) U.S. (including D.C.), and who are eighteen (18) years of age or older (each, an “eligible individual”). Void in U.S. Territories, including Guam, Puerto Rico, and where prohibited by law. Employees, officers, and directors of [SPONSOR LEGAL ENTITY, LLC] (“Sponsor”)[, ADMINISTRATOR ENTITY (“Administrator”) — if you use one], and each of their respective parent companies, affiliates, distributors, subsidiaries, prize providers, advertising/promotion agencies, and their immediate family members (i.e., spouses, parents, grandparents, children, grandchildren, and siblings, and each of their respective spouses), and/or those living in the same physical address (“household”) (i.e., people who share the same residence at least three (3) months a year, whether legally related or not) of any of the foregoing are not eligible to enter or win a prize in this Sweeps. Sponsor [, Administrator] and each of their respective parent companies, affiliates, distributors, subsidiaries, prize providers, and advertising/promotion agencies are each a “Released Party” and shall hereinafter collectively be referred to as the “Released Parties”.

Promotion Period

Sweeps begins at 12:00:01 AM Pacific Time (“PT”) on [M/1/YY] and ends at 11:59:59 PM PT on [M/last/YY] (“Promo Period”). Sponsor’s computer is the official time-keeping device for the Sweeps.

How to Enter

There are two (2) ways to enter, and both are treated equally. Entering by either method gives you the same chance of winning; purchasing anything on teargirl does not increase your chances of winning.

(1) Online / in-app entry. During the Promo Period, an eligible individual may receive entries by [DESCRIBE YOUR IN-APP ENTRY MECHANIC — e.g., “opening a digital pack on teargirl,” or “redeeming in-app mana,” etc. Each such action = one (1) entry into the Drawing Category identified for that action]. Eligible individuals may enter one (1) or more of the Drawing Categories (defined below).

(2) Free mail-in entry (AMOE). An eligible individual will receive one (1) entry into the applicable Sweeps drawing by hand printing their full name, complete home mailing address, telephone number, date of birth, email address, and the name of the Drawing Category they would like their entry included in on a plain 3″ x 5″ piece of paper and mailing it in a sealed, stamped, and hand-printed #10 envelope (with the name of the Drawing Category they would like to be included in written on the lower right-hand corner) to:

Enter as often as you wish by mail, but each entry must be mailed separately, name only one (1) Drawing Category, and be postmarked by [M/1/YY] and received by [M/7/YY].

Drawing Categories

Eligible individuals identify one (1) Drawing Category per entry. teargirl’s Drawing Categories correspond to the game’s rarity tiers. After identifying a Drawing Category, the entrant must write its name in two (2) places: (1) on the entry itself, and (2) on the outside of the mailing envelope in the lower right-hand corner (mail-in entries). Failure to properly identify the Drawing Category in both places may result in the entry being null and void. Only one (1) Drawing Category may be identified per entry; if more than one is written, or different categories are written on the card versus the envelope, the entry is null and void. Entries received for one (1) Drawing Category will not be included in any other Drawing Category. There is no limit on the number of entries an eligible individual may submit (including per Drawing Category).

Automated / Ineligible Entries

No photocopied, computer-generated facsimiles, mechanically reproduced, or mass entries are permitted, and any such entries are void. No software-generated, robotic, programmed, script, macro, artificial-intelligence, or other automated entries are permitted, and any entries received by such means will be void. Use of any device to automate or subvert entry is prohibited. All entries become the property of Sponsor and will not be acknowledged or returned. The Released Parties are not responsible for lost, stolen, incomplete, illegible, late, misdirected, delayed, garbled, damaged, inaccurate, undelivered, postage-due, or mutilated entries or mail; theft, destruction, or unauthorized access to or alteration of entries; defect or delay in mail processing; errors or omissions in these Rules or in any Sweeps-related materials; failures of electronic equipment, hardware, or software; or any other problems in connection with this Sweeps, including in the administration of the Sweeps, the processing of entries, or the selection or announcement of winners. Those who do not follow all instructions, provide the required information, or abide by these Rules may be disqualified. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant it believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweeps.

Selection of Winners & Odds

Potential winners will be selected in [N] individual random drawings (one (1) drawing per Drawing Category) conducted by [Sponsor/Administrator] on or about [M/10/YY], from among all eligible entries received for each Drawing Category during the Promo Period. In the event any Drawing Category does not receive any eligible entries, the prize allocated for that Drawing Category will go unawarded. Odds of winning depend on the total number of eligible entries received for each applicable Drawing Category during the Promo Period. All decisions regarding the selection of winners are final and binding. Potential winners will be notified by telephone, text message, mail, and/or email in a commercially reasonable time after the drawing. Released Parties are not responsible for false, incorrect, changed, incomplete, or illegible contact information, or for any notification that is lost, intercepted, or not received for any reason.

Prizes

A total of [N] prizes will be awarded in this Sweeps (one (1) per Drawing Category, listed in the table above). Federal, state, and local taxes and all other expenses not specified herein are each winner’s sole responsibility. ARVs are based on estimated value data available to Sponsor for the applicable trading card prior to the start of the Promo Period; values are subject to market fluctuation, and no winner will receive the difference (if any) between actual value at time of award and the stated ARV. Any individual receiving a prize valued by Sponsor at $2,000 or more will be required to provide Sponsor with a valid Social Security number before the prize is awarded, for tax-reporting purposes, and an IRS Form 1099 will be issued for the actual value of the prize (or, for a minor, in the name of the parent or legal guardian). Unclaimed prizes will be forfeited. Limit of one (1) prize per person, immediate family member, or household for this Sweeps.

Prize Details

At the winner’s selection, prizes may be either shipped to the winner’s selected address within the U.S. for free or otherwise deposited securely in the winner’s [vault/custody provider — e.g., PSA Vault] (fees may apply). If shipping is selected, please allow four (4) weeks to receive the prize. If vault deposit is selected, the winner must have or sign up for a valid account with [provider], including by agreeing to that provider’s user agreement; the prize will be deposited within ten (10) business days after the later of (a) the winner making the vault selection and (b) the winner making a valid account, after which the winner may continue storing the prize or have it withdrawn and shipped to a U.S. address at standard shipping cost. Prizes are non-transferable, with no cash redemptions, equivalents, or substitutions except at Sponsor’s sole discretion. If Sponsor is unable to provide the awarded prize, Sponsor may provide the approximate value in cash or award an alternate prize of comparable or greater value. All prizes are awarded “AS IS” without warranty of any kind, express or implied. No more than the stated prizes will be awarded.

Privacy

Submission of an entry constitutes your consent to participate and for Sponsor [and Administrator] to obtain, use, and transfer your name, complete mailing address, telephone number, date of birth, email address, and other information provided (collectively, “Sweeps Data”) for the purpose of administering this Sweeps, awarding prizes, and complying with applicable law. Except where prohibited, acceptance of a prize constitutes each winner’s irrevocable consent to the Released Parties’ use of the winner’s full name, likeness, photograph, voice, statements, social-media handles, opinions, biographical information, prize, and/or state/city of residence for advertising, promotional, and publicity purposes in any and all media, worldwide, in perpetuity, without further permission, notification, payment, or consideration except awarding of the prize.

Limitation of Liability

By entering the Sweeps, each entrant agrees that to the extent permitted by applicable law: (A) any and all disputes, claims, and causes of action arising out of or connected with the Sweeps, or any prize awarded, will be resolved individually, without resort to any form of class action; (B) any and all claims, judgments, and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; and (C) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, indirect, exemplary, punitive, incidental, consequential, or special damages, lost profits, and/or any other damages, regardless of the form of the action or theory of recovery, even if the Released Party has been advised of the possibility of those damages, other than actual out-of-pocket expenses not to exceed ten dollars ($10.00). Some jurisdictions do not allow these limitations, so the above may not apply to you.

Governing Law; Dispute Resolution

All issues concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of an entrant and the Released Parties, shall be governed by and construed in accordance with the substantive laws of the State of [Delaware / your state], without giving effect to any choice-of-law rules. Each entrant agrees to final and binding arbitration of all Claims (as defined in [reference to your User Agreement’s arbitration section], the “Arbitration Agreement”) before the American Arbitration Association pursuant to the written Arbitration Agreement. Please read the arbitration agreement carefully. It affects your rights and will have a substantial impact on how claims between entrants and the Released Parties will be resolved.

Miscellaneous

No transfer, assignment, cash redemption, or substitution of a prize will be permitted except by Sponsor, in its sole discretion, for a prize of equal or greater value. Each potential winner may be required to return an executed and notarized Affidavit of Eligibility, Liability Release, and (where legal) Publicity Release (collectively, “Prize Claim Documents”) within five (5) business days of notification before being eligible to receive a prize; failure to comply, or return of a prize or notification as undeliverable, results in disqualification and selection of an alternate, if time permits. Parents or legal guardians of a winner under the age of majority in their state of residence (eighteen (18) in most states, nineteen (19) in Alabama and Nebraska, twenty-one (21) in Mississippi) may be required to sign the Prize Claim Documents. Sponsor reserves the right, in its sole discretion, to void entries of, and disqualify, any entrant found to be tampering with the entry process or operation of the Sweeps, acting in violation of these Rules, or acting in an unsportsmanlike manner. Caution: Any attempt to undermine the legitimate operation of this Sweeps is a violation of criminal and civil laws, and Sponsor reserves the right to seek damages (including attorneys’ fees) to the fullest extent permitted by law. If Sponsor [or Administrator] is prevented from continuing the Sweeps by any event beyond its control (a “Force Majeure” event, including fire, flood, epidemic, pandemic, earthquake, labor dispute, act of God, communications or equipment failure, riot, terrorist activity, war, or any government order), Sponsor may amend, modify, suspend, or terminate the Sweeps or a prize and, in the case of termination, select winners from among all eligible, non-suspect entries received before the terminating event. By participating, entrants agree to defend, indemnify, and hold harmless the Released Parties from any liability, loss, injury, or damage of any kind (including attorneys’ fees) arising from (i) participation/entry; (ii) any submitted materials; (iii) acceptance, possession, use, or misuse of a prize; (iv) any claim of publicity/privacy violation, defamation, or IP infringement; and (v) any typographical or other error in the printing, offering, selection, operation, or announcement of any Sweeps activity or prize. The invalidity or unenforceability of any provision will not affect any other provision. In the event of a discrepancy between any Sweeps-related materials and these Rules, these Rules prevail.
